Using The Law To Your Benefit In Cleaning Up Your Credit…Improve Your Credit Score Now

 

There couldn’t have been a better time like now to negotiate settlements with your creditors and making requests with the Credit Bureaus or consumer reporting agencies to your benefit. It is just tough time in America right across the board and your creditors know it. We are almost in a recession, Federal Reserve Chairman Ben Bernanke stated recently. People across this Nation are losing their jobs, homes in foreclosure, repossession of their automobiles, etc. Things are tough for many Americans today.  It is a bad economy and people are having a tough time paying bills on time.

 

However, you should not fall victim to these tough times. Now is the time to preserve and clean up your credit. I cannot emphasize enough how important it is for you to invoke and apply the law in cleaning up your credit. For example, if you are disputing any thing negative, erroneous or inaccurate on your credit reports, this is your best strategy to fight it.

The federal Fair Credit Reporting Act (FCRA) provides that you may: (1).request a description of how the Credit Bureaus verified the information including the business name and address contacted, and telephone number, if reasonably available. (Note: The name and address information also appears on your original credit report).

(2). Add a statement disputing the accuracy or completeness of the information.

(3). Request that Credit Bureaus send these results to organizations who have reviewed your report in the past two years for employment purposes or six months for any other purpose. (Twelve months for residents of Colorado, Maryland and New York).

7. You may seek damages from violators. If a consumer reporting agency or, in some cases, a user of consumer reports or a furnisher of information to a consumer reporting agency violate the FCRA, you can sue in state or federal court.

Beware Of Credit Repairers and Consultants!!!!!!!!

With bad credit and a low credit score which may have resulted from lack of employment, a bad economy, recession, one’s own negligence or mistake, etc., many Americans are reeling to increase their credit scores and to repair their credit. Your credit score in this country (USA) can make or break you. It is very, very imperative that you maintain at least a fairly decent credit score of no less than 650.  Any persons who want to make it in the American society should aim at maintaining a credit score of 750 and above.

There are numerous organizations and businesses out there that are taking serious advantage of people with bad credit. Many of these so called Credit Repairers are charging mega bucks (dollars) by making false promises to delete accurate, inaccurate and erroneous credit data from one’s credit profile, thus increasing your credit score. Be careful of these Credit Consultants. While you have the right to challenge any negative, inaccurate and erroneous data on your credit profile in accordance with the Fair Credit Reporting Act (FCRA), it is deceptive practice for any Credit Repairers or Consultants to make false promises in enticing you to give up thousands of dollars to clean up or repair your credit. That is a violation according to the Federal Trade Commission which monitor these organizations.

Reading Your Credit Profile Is Crucial

One of the problems I encountered assisting clients in restoring and repairing their credit is the fact that some of them do not read. Moreover, even those that read a little, their comprehension skills are very, very poor. Not many people were able to go to college for reasons beyond their control and we should not frown on them. Let us help them. It is unfortunate that many of our schools are graduating students who cannot read and write. Then of course you have those who didn’t take their early education seriously. But all is not lost. Human beings are the most complex creation. It is never too late to learn. As a matter of fact, if you apply yourself, stay focus and motivated, you can be the very best at reading and writing. Living in a world today where modern technology rules, there is hope. Applying The Law In Disputing Negative Data From Your Credit Profile

Knowing your rights and applying the law is one of your most effective weapons to dispute inaccurate and erroneous data from your credit profile, thus improving your credit score. Upon receiving your free credit reports from the Credit Bureaus, it is imperative that you write a letter immediately to any or all the creditors  who have reported negative and inaccurate data invoking your rights under the law.

For example, this letter would be an excellent format to use in disputing any inaccurate data from your credit profile: Your firm is hereby placed on notice that the account information provided to Equifax, Experian and Trans Union is erroneous. Pursuant to section 623 of the Fair Credit Reporting Act-as modified by the Fair and Accurate Credit Transaction Act-it is illegal for your firm to report credit data that is known to be false as well as the failure to communicate that a debt is, in fact, disputed.

What To Do To Improve Your Credit Score

By getting your credit reports from the three (3) Credit Bureaus, namely: Equifax, Trans Union and Experian, you are now ready to unleash your rights by having inaccurate and erroneously reported data from your credit profile.

Take time out to go through your reports with a fine teeth comb. Get a hi-liter and mark the data that is either incorrect or negative on all three (3) credit reports. You are now ready to dispute anything that is negative and inaccurate from your reports. This will undoubtedly increase your credit scores making you more credible with Creditors.

Please note that data that is accurate is not going to get deleted. Do not get any false hope here. EVERYONE MAKES MISTAKES, but those that hurt your credit score should be avoided at all cost.

All it takes is one little drop in your credit rating to spark a surge of lender notifications about higher interest rates, lower credit limits and denied applications. Fair Isaac’s FICO score, which most lenders use, rates consumers’ creditworthiness on a scale of 300 to 850 — 850 being a perfect score. On a $300,000, 30-year fixed-rate mortgage, someone with a solid score of 700 could snag an interest rate of 5.99%, translating to a monthly payment of $1,797. Lose just one point, and you’d get a less favorable rate of 6.27% and pay $19,800 more in interest over the life of the loan. Ironically, consumers with good credit have more to fear than those who already have a blemish or two on their record. “The higher your score, the farther it can fall,” says Craig Watts, a spokesman for Fair Isaac. “[One mistake] suddenly puts you in a very different category of consumer.”

The Importance Of A Good Credit Score

As many Americans today are feeling the economic pinch, it is important to know the importance of staying afloat by maintaining a good credit score.

Credit Score is a measure of credit risk calculated from a credit report using a standardized formula. Banks, Creditors, Lenders, etc., use Credit Score to determine one’s eligibility for a loan, mortgage, etc., and what rate to charge.
